NCC Warns Dealers, Importers Over Unapproved SIM-Enabled Devices

The Nigerian Communications Commission, NCC has warned manufacturers, importers, distributors and retailers of SIM-enabled devices to comply with mandatory type approval and device verification requirements, cautioning that non-compliant devices could eventually be barred from Nigerian mobile networks.

The commission said it was strengthening enforcement of existing regulations through an automated, technology-enabled compliance process designed to verify devices entering and circulating in the Nigerian market.

The requirements are backed by the Nigerian Communications Act 2003, the Type Approval Regulations 2024 and the Type Approval Business Rules 2024.

Under the rules, all device models intended for importation, assembly, distribution or sale in Nigeria must obtain NCC type approval, as required by Section 132 of the Act and Regulation 4 of the 2024 regulations.

Original Equipment Manufacturers, Original Device Manufacturers, importers and other responsible suppliers must also submit individual devices’ International Mobile Equipment Identity (IMEI) information through the approved compliance process for verification before distribution or sale.

The NCC directed businesses to review existing stock and work with their suppliers to address outstanding compliance issues. Newly imported devices must also meet the applicable approval and verification requirements before being placed on the market.

The commission said it had engaged manufacturers, importers and industry associations on the process, urging businesses that had not participated in the consultations or required further clarification to seek assistance through its approved onboarding channels.

According to the NCC, the automated process will strengthen oversight of communications devices and help identify irregularities in their importation and distribution.

Working with the Nigeria Customs Service, the system is also expected to support reconciliation of import records, compliance with applicable duties and fair competition among businesses.

The commission warned that devices found not to meet the applicable requirements may be restricted from accessing Nigerian mobile telecommunications networks under the approved enforcement framework.

It said the initiative was intended to improve compliance, protect consumers and promote a fair and sustainable market for communications devices.
